3. Server listings and content

If you submit or manage server listings, you represent that you have the right to provide the information and materials you upload (including names, descriptions, images, and links). You retain ownership of your content, but you grant EpicTop100 a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and distribute that content solely to operate, promote, and improve the Service. You are solely responsible for your listings and for compliance with applicable laws, game publisher terms, and third-party rights.

4. Voting and fair use

Voting features are provided to reflect community interest. You agree not to manipulate votes through technical means, multiple identities, incentives that violate law or third-party rules, or other abusive behavior. We may apply cooldowns, rate limits, verification, or other measures, and may disregard or remove votes or listings we reasonably believe are fraudulent or abusive.

5. Acceptable conduct

You agree not to:

• Use the Service for any unlawful purpose or to promote illegal activity.
• Harass, threaten, defame, or harm others; post hateful, obscene, or otherwise objectionable content; or violate others’ intellectual property or privacy rights.
• Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems; interfere with or disrupt the Service; or scrape or overload the Service in a way that impairs its operation.
• Provide false or misleading information when registering or submitting listings.
• Use the Service to distribute malware, spam, or deceptive links.

The Service lists and links to third-party game servers and websites. We do not control and are not responsible for third-party content, services, or conduct. Your use of third-party servers is at your own risk and subject to those parties’ terms and policies.

7. Intellectual property

The Service, including its design, branding, and software (excluding user-submitted content), is owned by EpicTop100 or its licensors and is protected by intellectual property laws. Except as expressly allowed in these Terms, you may not copy, modify, or distribute our proprietary materials without prior written consent.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT RANKINGS OR VOTE COUNTS REFLECT ANY PARTICULAR STANDARD OF QUALITY OR SAFETY OF THIRD-PARTY SERVERS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EpicTop100 AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), IF YOU HAVE NOT PAID US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You will defend, indemnify, and hold harmless EpicTop100 and its affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content or listings, or your violation of these Terms or applicable law.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for conduct that we believe violates these Terms or harms the Service or other users. Provisions of these Terms that by their nature should survive will survive termination (including disclaimers, limitations of liability, indemnity, and governing law).

12. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules. You agree that courts located in Delaware have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service, except where prohibited by applicable law (for example, where you have mandatory consumer rights in your country).
